INDIVIDUAL READINGS & SESSIONS

Booking Policies

  • Appointments with Nicole (Empowered Soul, Inc.) are only made through her website / Acuity and are confirmed once payment is received at the time of booking

  • By making an appointment with Nicole (Empowered Soul, Inc.), you understand and agree that readings are for entertainment purposes only, and no guarantee can be given as to the accuracy of a reading. Any predictions shared during a reading are based on present potentials only, as the actual future cannot be definitively predicted due to the nature of free will and changing circumstances. You also agree that readings are subject to interpretation and do not replace or substitute for professional advice. Any decisions or actions you take based upon your reading are your sole responsibility; you are in charge of your own life. See Comprehensive Disclaimers section below for complete terms.

  • It is the responsibility of the client to keep their scheduled appointment. Appointment date and time can be found on their invoice and/or their calendar invite

  • Session recordings may not be shared, distributed, or used for any commercial or public purposes without prior consent

Reschedule & Refund Policies

  • No cancellations or refunds will be allowed unless there are extenuating circumstances, which is up to Nicole's discretion.

  • If you need to reschedule your appointment you must request that reschedule at least 48 hours prior to your appointment time. For all rescheduled appointments, you will be able to select based on availability.

  • Late appointments will not be accommodated for lost time. Late appointments exceeding 10 minutes will be considered a no-show and canceled without a refund

  • In the event that Nicole (Empowered Soul, Inc.) needs to cancel an appointment, the option will be given for a refund or a reschedule

  • All sessions once complete are non-refundable

Session Recording Rights

  • By participating, you consent to recording.

  • Session recordings are confidential and for personal use only unless you provide written consent for other uses.

PROGRAMS & COMMUNITY

Terms & Conditions

  • Recording Notice: Please be aware that all live classes, sessions, and interactions within Nicole's programs and communities are recorded. By participating, you consent to being recorded and agree that these recordings may be used for educational, promotional, and/or commercial purposes. This includes discussing contents of these programs, or sharing full or partial recordings on social media and/or Nicole's Podcast (Empower Your Soul).

  • Privacy and Confidentiality: While we strive to maintain a safe and respectful environment, please be mindful that personal information shared during live sessions may be included in the recordings. We encourage you to share only what you are comfortable with being public.

  • Program Content and Structure: Please note that program content, timing, and structure are subject to change at any time without prior notice. We aim to provide the best possible experience, and adjustments may be made to enhance or adjust the learning environment.

  • Content Usage: All materials, recordings, and content provided in Nicole's programs are for personal use only. Redistribution, reproduction, or sharing of these materials without permission is strictly prohibited.

  • Educational and Wellness Programs: Educational and wellness programs are designed for personal development and general wellness purposes. Program content may combine evidence-based education with traditional wisdom practices for learning and personal growth. While programs may include tools and techniques for wellness and personal development, they are not intended to diagnose, treat, cure, or prevent any medical or psychological condition.

  • Mediumship and Spiritual: All readings, mediumship demonstrations, and spiritual information provided in these programs are for entertainment and personal exploration purposes only.

  • Community Guidelines and Consequences: Participants asked to stop any harassing behavior are expected to comply immediately. If a participant engages in harassing behavior, the administrators may take any action they deem appropriate, up to and including expulsion from the community and identification of the participant as a harasser to other members. Removal from any program or community is at Nicole's sole discretion and may be done without prior notice or refund.

  • Cancellations and Refunds: These are membership-based programs with varying structures (some evergreen, some cohort-based). You may cancel your membership at any time through your account settings. Upon cancellation, your membership and access to all content will continue through the end of your current paid period. No partial refunds will be issued under any circumstances.

  • Changes to Terms of Service: These terms may be updated periodically. Continued participation in Nicole's programs constitutes acceptance of any changes.

Entertainment and Educational Purposes

  • Psychic and medium readings are subject to interpretation and are not 100% accurate. All readings, spiritual guidance, and mediumship demonstrations are for entertainment and personal exploration purposes only and do not replace or substitute for professional legal, medical, financial, psychological, therapeutic, or psychiatric advice, opinions, diagnosis, and/or treatment. Educational and wellness programs are designed for personal development and general wellness purposes and are not intended to diagnose, treat, cure, or prevent any medical, psychological, or psychiatric condition.

Professional Limitations and Scope of Services

  • The use of the word "healing" does not mean that Nicole diagnoses, treats, cures, or prevents any physical, mental, emotional, or spiritual condition. Personal Responsibility and Free Will

  • Any decisions or actions you take based upon your reading, program participation, or any service are your sole responsibility; you are in charge of your own life, decisions, and outcomes. No psychic, medium, teacher, or spiritual advisor can guarantee an outcome, exert control over you, or force you to follow or dismiss any specific course of action. You have free will and your own intuition, common sense, knowledge, and personal agency to arrive at all life decisions.

  • You acknowledge and understand that spiritual, educational, and wellness guidance is subjective and may not align with your personal beliefs, values, or circumstances. No Guarantees or Warranties

  • Nicole makes no offers of guarantees, warranties, representations, or promises, whether written, expressed, or implied, as to the results, outcomes, or benefits you will or may receive from any service, reading, program, course, or material provided. Individual results vary significantly and depend on many factors including but not limited to your commitment, consistent application of materials, personal circumstances, life situation, belief systems, openness to change, existing support systems, and individual differences in learning, processing, and implementing information.

  • Results, if any, are not typical, and no representation is made that you will achieve any specific results. Success in personal development, spiritual growth, or life improvement requires personal effort, dedication, and often professional support beyond what any single service or program can provide.

Comprehensive Release and Assumption of Risk

  • You agree to book, attend, and participate in any reading, program, course, or service fully understanding and agreeing to all terms of this disclaimer. By engaging with Nicole's services, you acknowledge that you do so voluntarily and at your own risk, and you assume full responsibility for any and all risks associated with such participation.

  • By booking and attending any service with Nicole (Empowered Soul, Inc.), you agree that you, your heirs, assigns, successors, and anyone personally or professionally associated with you or your estate, fully and completely release, discharge, and hold harmless Nicole (Empowered Soul, Inc.) and anyone associated with the business, including but not limited to employees, contractors, affiliates, partners, and representatives, from any and all known or unknown claims, demands, causes of action, lawsuits, damages, losses, costs, expenses, and liabilities of any kind whatsoever against Nicole or the business as a result of:

  • Traveling to, arriving for, participating in, or departing from any reading, session, program, or service

  • Receiving any reading, guidance, information, advice, or spiritual communication

  • Any actions taken, decisions made, or outcomes experienced before, during, or after any service

  • Participation in any program, course, community, or educational offering

  • Use of any materials, tools, techniques, or information provided

  • Any emotional, psychological, spiritual, physical, financial, or relational impact or consequence

  • You further agree that you take full and complete responsibility for your behavior, actions, decisions, and all consequences thereof, whether foreseen or unforeseen. You acknowledge that spiritual and personal development work can bring up intense emotions, memories, or psychological material, and you agree to seek appropriate professional support if needed.

Hold Harmless and Indemnification

  • You agree that you and anyone personally or professionally associated with you, including your estate, heirs, successors, and assigns, will defend, indemnify, and hold completely harmless Nicole (Empowered Soul, Inc.) and all associated parties from any and all claims, actions, demands, lawsuits, damages, losses, costs, expenses, and liabilities, including but not limited to attorney fees, court costs, and costs associated with defending any claims, lawsuits, or legal actions that may arise from:

  • Your participation in any service, program, or offering

  • Your use or misuse of any information, guidance, materials, or techniques provided

  • Any actions you take or decisions you make based on services received

  • Any violation of these terms and conditions

  • Any breach of your representations or warranties herein

Limitation of Liability and Damages

  • Nicole (Empowered Soul, Inc.) will not be held liable for any damages, losses, costs, expenses, or consequences resulting from the use of any website, social media accounts, platforms, or as a result of any reading, appointment, program, course, or service with Nicole, or any persons, events, circumstances, or situations related thereto, and/or any actions, decisions, or outcomes that you may experience as a result.

  • This includes but is not limited to any direct, indirect, incidental, consequential, special, punitive, or exemplary damages resulting from any claims arising from any act, omission, negligence, misrepresentation, or otherwise, including without limitation: personal injury, emotional distress, psychological impact, spiritual crisis, death, loss of income or earning capacity, business losses, relationship issues, family conflicts, stress (emotional, psychological, physical, or otherwise), errors, omissions, or any other damages or losses of any kind.

  • In no event shall Nicole's total aggregate liability to you for all damages, losses, and causes of action (whether in contract, tort, or otherwise) exceed the total amount you have actually paid to Nicole for the specific service or program in question.

Healthcare and Professional Treatment

  • The advice, information, services, tools, techniques, and other content provided through any service, website, social media, or platform are provided for informational, educational, and entertainment purposes only. Users should only use this information to facilitate discussions about treatment options with their physician, mental health professional, or other healthcare professional (collectively, "Healthcare Professional").

  • Any information provided is never intended as a substitute for advice, diagnosis, or treatment from your Healthcare Professional, even if the information appears to be of a medical, psychological, or therapeutic nature.   • INDEMNIFICATION: You agree to indemnify and hold harmless Nicole (Empowered Soul, Inc.), her employees, contractors, and affiliates from any claims, damages, or expenses (including attorney fees) arising from your use of services or violation of these terms.

  • DATA PRIVACY: Personal information shared during sessions may be used for service delivery and business purposes. We do not sell personal information to third parties. By booking services, you consent to our data handling practices.

  • INTELLECTUAL PROPERTY: All content, materials, and methodologies are proprietary to Nicole/Empowered Soul, Inc. Unauthorized use, reproduction, or distribution is prohibited.

  • TECHNICAL ISSUES: Nicole is not responsible for technical difficulties, internet connectivity issues, platform malfunctions, or any technology-related problems that may affect your access to or participation in programs.

  • THIRD-PARTY CONTENT: Programs may include references to or links to third-party websites, resources, or content. Nicole is not responsible for the accuracy, completeness, or availability of such third-party content.

  • THIRD-PARTY PLATFORMS: Services may use third-party platforms (Zoom, scheduling software, etc.). Nicole is not responsible for third-party platform issues, outages, or data handling practices.

  • FORCE MAJEURE: Nicole is not liable for delays or inability to perform due to circumstances beyond her control (natural disasters, technical failures, government actions, etc.).

  • SEVERABILITY: If any part of these terms is found unenforceable, the remaining terms remain in full effect.
